These Terms of Use (the "Terms") govern your access to and use of Kingsport Scoop, including our website, newsletters, emails, social channels, and any other content, features, or services we provide (collectively, "Kingsport Scoop" or the "Service"). By accessing or using Kingsport Scoop in any way, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not access or use Kingsport Scoop.

1. Acceptance of the Terms

These Terms of Use are a binding agreement between you ("you" or "your") and Kingsport Scoop ("Kingsport Scoop," "we," "us," or "our"). They apply to your access to and use of our locally focused news, event listings, recommendations, and related content and services, whether you access them as a website visitor, email subscriber, or in any other manner.

By accessing, reading, subscribing to, or otherwise using Kingsport Scoop, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms or the Privacy Policy, you must not use Kingsport Scoop.

2. Eligibility

Kingsport Scoop is offered and available only to individuals who are at least 16 years old. By using the Service, you represent and warrant that you meet this age requirement and are otherwise legally capable of entering into a binding contract under the laws of the State of Tennessee. If you do not meet these requirements, you must not access or use Kingsport Scoop.

We may revise and update these Terms from time to time in our sole discretion. When we make changes, we will revise the "Last updated" date at the top of this page. All changes are effective when posted and apply to all access to and use of Johnson City Scoop thereafter.

Your continued use of Kingsport Scoop after changes are posted means that you accept and agree to the updated Terms. You are responsible for checking this page periodically so that you remain informed of any changes, as they are binding on you.

4. Access to Johnson City Scoop and Account Security

We reserve the right to withdraw, modify, or discontinue any content or feature of Kingsport Scoop, or the Service as a whole, in our sole discretion without notice. We will not be liable if, for any reason, all or any part of the Service is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Service, or the entire Service, to users, including subscribers.

You are responsible for making all arrangements necessary for you to have access to Kingsport Scoop and for ensuring that all persons who access the Service through your internet connection or email account are aware of and comply with these Terms.

If we allow or require you to create an account, sign up for a newsletter, or otherwise provide registration information, you agree to provide accurate, current, and complete information and to maintain and promptly update such information as necessary. You agree that all information you provide is subject to our Privacy Policy, and you consent to all actions we take with respect to your information consistent with that policy.

5. Intellectual Property Rights

All content, features, and functionality available through Kingsport Scoop—including, but not limited to, text, articles, photographs, graphics, logos, icons, audio, video, design, and the arrangement thereof—are owned by Kingsport Scoop, our licensors, or other content providers, and are protected by United States and international copyright, trademark, and other intellectual property laws.

You may use Kingsport Scoop for your personal, non-commercial use only. You must not reproduce, distribute, modify, publicly display, publicly perform, republish, download, store, or transmit any material on our Service, except as incidental to viewing or reading that content (for example, caching an article in your browser or printing a single copy for your personal reference). Any other use requires our prior written permission.

6. User Contributions and Content Standards

We may, from time to time, allow users to submit, post, or otherwise provide content to us or through Kingsport Scoop (for example, event information, comments, or business listings). Any content you submit is referred to as "User Contributions." You are solely responsible for your User Contributions, including ensuring that they are accurate, lawful, and appropriate.

By providing any User Contribution, you grant Kingsport Scoop a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in connection with operating, promoting, and improving Kingsport Scoop.

User Contributions must, in their entirety, comply with all applicable federal, state, and local laws and regulations, including those of the State of Tennessee. Without limiting the foregoing, User Contributions must not:

  • Contain defamatory, obscene, harassing, hateful, or otherwise objectionable material.
  • Promote or depict violence, self-harm, animal cruelty, or illegal activity.
  • Include sexually explicit or pornographic material.
  • Infringe any patent, trademark, copyright, trade secret, or other intellectual property right of any party.
  • Violate the privacy, publicity, or other legal rights of others, including by posting private or identifying information without consent.
  • Impersonate any person or organization, or misrepresent your affiliation with any person or organization.
  • Be likely to deceive, mislead, or confuse others.
  • Give the false impression that your content is endorsed by or originates from Johnson City Scoop, if that is not the case.

We reserve the right, in our sole discretion, to edit, refuse to publish, or remove any User Contribution for any reason or no reason, without notice. However, we do not undertake to review all content before it is posted and cannot guarantee prompt removal of objectionable material once it appears.

We respect the intellectual property rights of others and expect users of Kingsport Scoop to do the same. If you believe any content available through our Service infringes your copyright, you may contact us with a written notice that includes all of the following:

A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf;

Identification of the copyrighted work claimed to have been infringed;

Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material (for example, the URL or a full description of where the material appears on the Service);

Contact information for the complaining party, including address, telephone number, and email address;

A statement that the complaining party has a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law;

A statement, under penalty of perjury, that the information in the notification is accurate and that the complaining party is the copyright owner or authorized to act on the owner's behalf.

Upon receipt of a valid notice, we will remove or disable access to the allegedly infringing material and will make reasonable efforts to notify the party who posted the content. If you believe your content was removed in error, you may send a counter-notice that meets the requirements of the Digital Millennium Copyright Act. We also reserve the right to terminate accounts of users who are repeat infringers in appropriate circumstances.
